SC notice to police on petition challenging bail to doctor
New Delhi, Nov 28: In the recent case of a city doctor allegedly raping a minor girl patient, the Supreme Court today issued notice to the Delhi Police on a petition challenging a Delhi High Court order granting bail to the accused.

A bench comprising justice Doraiswamy Raju and justice
Arijit Pasayat also issued notice to the doctor on the
petition filed by the mother of the sexually abused girl.
Appearing for the petitioner, counsel Colin Gonsalves and Aparna Bhat contended that the high court erred in granting bail in a non-bailable offence that too on the ground of delay in filing of FIR where there was none.
The counsel further contended that in such a serious offence, the high court chose to grant bail saying the relief needed to be granted to the accused keeping in view his family background.
Justice S K Aggarwal of the high court had granted bail to the 55-year old doctor V K Nigam on his furnishing a bail bond of Rs 25,000 and a surety of the like amount to the satisfaction of the trial court. According to the prosecution, the 13-year-old girl had visited the accused doctor at Holy Angel Hospital in Vasant Vihar on September 23 for treatment for TB at around 1100 hours. He took the victim for examination and allegedly sexually assaulted her. Police had lodged the FIR at 2150 hours.
Meanwhile, an NGO national campaign against child sexual abuse has given a notice to the Medical Council of India and the Medical Council of Delhi seeking to know what action they has proposed to take against the erring doctor. Bureau Report
