Chandigarh, May 16: Absconding first class judicial magistrate S S Bhardwaj sought anticipatory bail on which a notice was issued to CBI today even as the police remand of suspended Jalandhar district and sessions judge R M Gupta was extended till tomorrow. A special court today issued notice to CBI for May 19 on Bhardwaj's petition in which he pleaded that he had been "falsely implicated" and the recoveries shown from him were "planted by the CBI".
His counsel contended that Bhardwaj was not absconding and that he was out of station on May 9 and May 10, the day the investigating agency is supposed to have raided his house.
Hearing the argument, special judge Balbir Singh issued notice to CBI.
Bhardwaj's counsel told reporters outside the court premises that his client would join the investigation if granted bail. Meanwhile, chief judicial magistrate C L Mohal here this evening extended the police remand of Gupta till tomorrow.
Submitting a "confessional statement" of Gupta in the court, the public prosecutor had sought another nine days of police remand for the suspended sessions judge claiming that the investigating agency needed to verify his properties acquired at various places in Punjab.
"He and co-accused (Bhardwaj) are not cooperating in the investigation," the CBI counsel said.
Gupta made a statement that the CBI had names of some persons belonging to places where he had been posted in the past and that a number of statements were "extracted under pressure" from him. Gupta, who was arrested on May 11, was on police remand till today.
Bhardwaj is alleged to have given CBI sleuths a slip after the investigating agency raided his residence on May 10. The CBI claimed to have recovered Rs seven lakh, which he had allegedly taken as bribe from an accused. Bureau Report
