Pune, Jan 20: A special court today rejected the application moved by special investigation team (SIT) seeking separation of four accused lodged in Yerwada jail on the ground that "as they were indulging in conspiracy to divert the investigations." The designated judge S M Shembole rejected the application saying that there was no such provision in the law.


In its plea filed on January 2, the SIT had sought separate jails for Samajwadi Janta Party MLA Anil Gote, suspended police officer Dilip Kamath, Azim Telgi who is the brother of kingpin Abdul Karim Telgi and his counsel Rashid Kulkarni saying they were hatching conspiracies while lodged in the prison.


The SIT in its application had said that the four accused were diverting the attention of the investigating agency elsewhere by writing `frivolous and vexatious' letters to the court, legislature and the governor.


As a result, the time of the investigating agency was wasted in answering queries from different quarters where the accused are sending letters, the SIT said in its application.


The defence counsel in the earlier hearing argued that the prisoners cannot be moved from one jail to the another without the permission of the inspector general of prison.
