Dhaka, June 22: In a move that is likely to create ripples in Bangladesh's political and legal fraternity, a new chief justice was appointed today superceding two judges of the appellate division, first time ever a chief justice has been so appointed bypassing the rule of seniority. President Professor Iajuddin Ahmed as per power conferred on him by the constitution today appointed Justice K M Hasan who is junior to two judges in the appellate division of the Supreme Court apparently to correct a " wrong" decision of the previous Awami League government.

The Supreme Court has two divisions - high court division and appellate division. It is the discretion of the government to appoint judges of high court division to the appellate division, the apex court. Never in over three decades of Bangladesh's history, has a chief justice been made superceding another judge in the appellate division.

By appointing Justice Hasan as chief justice of the country the Prime Minister Begum Khaleda Zia's four-party alliance government set a precedent, said a legal expert. The appointment of a new chief justice on the last working day of the sitting chief justice was another precedent. Such appointment were always made some days earlier, court sources said. Official sources said Justice Hasan will take oath as the 13th Chief Justice of Bangladesh tomorrow to be conducted by president. He will serve till the later part of January next year when completes 65 years, the time to retire as judge of Supreme Court.

The outgoing Chief Justice Mainur Reza Chowdhury who served as CJ for little over a year had his last working day today.
