Allahabad, Oct 22: Allahabad High Court today issued notice to the Attorney General of India on a writ petition filed against an MLA in Farrukhabad who is still holding the post several years after his conviction. A division bench comprising Chief Justice Tarun Chatterjee and Justice Ashok Bhushan issued notice to the AG on the petition filed by Sunil Dutt Dwivedi, son of slain former Uttar Pradesh minister Brahma Dutt Dwivedi has challenged legislator Vijay Singh's right to remain an MLA of Farrukhabad.
According to the petition Article 191 of the Indian Constitution as well as Section 8(3) of Representation of People's Act, 1951, debar, an MLA or MP convicted in a case to hold the post of people's representative.
A local court here had given life imprisonment to Singh in Dwivedi murder case against which he has obtained a bail.
Dwivedi was murdered eight years ago.
