Mumbai/Bangalore, Dec 19: Prime accused in the multi-crore fake stamp paper probe Abdul Karim Telgi today faced a lie detector test in Bangalore after Mumbai High Court allowed the special investigating team (SIT) to conduct the scientific tests on him and seven others. Telgi underwent lie detector test at a forensic lab at Bangalore today, SIT chief Sri Kumar told.

In Mumbai, the high court allowed SIT to perform P-300 brain finger-printing, lie detector and narco-analysis tests on the alleged kingpin Abdul Karim Telgi and seven others but restrained it from subjecting co-accused Ramachandra Rama Reddy to these scientific methods of investigation.

The court was hearing a petition filed by Reddy who had challenged a special court`s order of December 15 allowing the scientific tests on nine accused. The court granted relief only to Reddy and posted the matter for admission on January six next.

Prosecutor Raja Thakre justified the scientific tests on the accused saying SIT needed evidence to corroborate with the incriminating material in the telephonic talks between Telgi and others on bribes paid to cops to hush up cases and go soft on him in custody.

He said the accused should be subjected to these tests as they were not cooperative. The prosecutor also relied upon a Supreme Court judgement which held that the prosecution could not achieve much breakthrough in the Best Bakery case because it had not resorted to scientific methods of investigation.
The court thereafter allowed SIT to hold tests on Telgi and others except Reddy.


Reddy argued that these tests involved injecting chemicals in the body and the accused could be forced to take them. He further said that the tests were violative of the constitution which laid down that an accused could not be forced to become a witness against himself.

Besides Telgi, other accused who are slated to undergo these tests are Anil Shah, Manoj Mehta, Dilip Kamath, Anil Gote, Abdul Azim Telgi, Abdul Rashid Kulkarni and Dattatraya Dal.

Kamath and Dal are suspended police officers while Gote is sitting MLA from Dhule. Rashid Kulkarni and Abdul Azim are lawyer and brother respectively of prime accused Abdul Karim Telgi. Except Telgi, all the accused are lodged in Pune jail.

While Telgi is undergoing these tests in Bangalore today, others would be subjected to these tests later, SIT sources in Mumbai told.

The Pune Court had earlier allowed SIT to hold the three scientific tests. In a separate order, however, the same court had disallowed SIT to conduct voice tests of the accused. Bureau Report
