Jabalpur, Aug 13: Madhya Pradesh High Court today
reserved its orders on a petition challenging the orders of
the Centre and the state government to open the controversial
Bhojshala-Kamal Maula mosque in Dhar district.
Justice A K Mishra reserved his orders after conclusion
of arguments by the counsel for the petitioners, a group of
Muslims from Dhar district headed by Shahar Kazi Zakaullah and
nominated members of the State Wakf Board, who filed the writ
petition in their representative capacity.
Challenging the orders, the petitioners also prayed for
quashing the modified orders dated April 7 last terming them
as arbitrary and illegal for ostensibly converting the 'Kamal
Maula Masjid' into 'Puja Ghar' without the consent and
concurrence of Muslims.
Petitioners' counsel Shobha Menon submitted that the
Director General of Archaeology by changing the rules for the
protection and maintainances of old monuments, had transgressed
his powers in allowing the Hindu community to offer puja in
the said Kamal Maula Masjid at Bhojshala. These change of
rules had violated the customary rights of the Muslim
community to offer Namaz exclusively.
