Ghaziabad, Nov 06: The 10 persons sentenced to life imprisonment in the Safdar Hashmi murder case by a sessions court here will appeal against the judgement in high court and move bail application, Defence Attorney Jai Prakash Sharma said today.
Sharma said he would move bail application in high court after seeking a copy of additional district and sessions judge C D Rai's judgement.
He said the learned judge did not throw light on issues relating to flaws and different versions in the case while passing his judgement yesterday. He said these would be raised in high court when the sentenced go in for appeal.
In his 32-page judgement, Rai said both prosecution and defence were responsible for the 14 years delay in delivering a verdict. Rai said unnecessary applications by prosecution and defence made them "equally responsible for causing 14 years delay in justice." He said transfer of the case from one court to another was also responsible but added that "justice delayed is not justice denied."
Hashmi, a well-known theatre personality and CPI-M activist, was killed on January 01, 1989, in Jhandapur in Sahibabad when he was enacting a play 'Halla Bol' alongwith wife Molayashree Hashmi in support of CPI-M candidate Ramnath Jha in Ghaziabad municipal elections. Yesterday, the judge awarded life sentence to prime accused Mukesh Sharma, an independent candidate in the Ghaziabad municipal elections, and his associates Devi Sharan Sharma, Jitender, Ram Avtar, Vinod, Yunus Ali, Tahir Hussein, Ramesh and Karan Singh.
