New Delhi, Dec 09: The Delhi High Court today asked the Tihar Jail authorities to produce Tandoor murder case convict Sushil Sharma before it on December 17 as it wanted to know which counsel the former youth congress leader would like to be represented by during hearing on the reference from the trial court for confirming his death sentence. A bench of Justice Vijender Jain and Justice R C Jain issued the warrant for Sharma's production after Delhi Police counsel Mukta Gupta submitted that the convict should be asked about his choice of counsel.
Meanwhile, Sharma's appeal against the trial court order on his conviction and death sentence was likely to come up for hearing within a day or two.
Only yesterday Sharma challenged Additional Sessions Judge G P Thareja's November 03 order convicting him in the case.
Counsel Jayant Sud filed the appeal on behalf of Sharma, who was held guilty of murdering live-in partner Naina Sahni and burning her body in an oven of a restaurant in the heart of the capital eight years ago. Interestingly, at the time of being sentenced Sharma had ruled out going in for appeal.
Sud said the trial court order has been sought to be reversed on the ground that it failed to appreciate the evidence on record which did not support the prosecution case.
