Kolkata, May 12: The Calcutta High Court today observed that any decision taken by the Indian Institute of Management (Calcutta) authorities on a resolution taken at its March 26 board of governors meeting, would abide by the result of the case filed by the faculty council. Justice Pinaki Ghose, after hearing the contention of the parties in the case, directed them to file affidavits and adjourned the case till six weeks after summer vacation. Appearing for the central government, Additional Solicitor General S K Kapur opposed the writ petition claiming that the petitioner had suppressed material fact that they had already made an application on the same cause of action before the Supreme Court and as such the writ was not maintainable. Kapur stated that there was no illegality in appointing six members on the board of governors at IIM(C), claiming that according to rules, the Centre before appointing new members, should consult the issue with the state government. He submitted that this consultation had been made long before in 2000, and claimed that as such the question of illegality was not tenable.

Counsel for IIM(C) board chairman Y C Deveswar, Hirak Mitra submitted that the memorandum of association of the premier management institute empowered him to adopt the resolution and as such there was no illegality on the part of the chairman in adopting the resolution.


The faculty council had in its petition challenged the appointment of six new members on the board of governors of IIM(C) by the HRD Ministry, claiming that the appointments were illegal, and also that the 164th board meeting of March 26 was illegal.
