New Delhi, May 15: Nearly five years after CBI registered a corruption case against a DVB officer, a special court has acquitted him of the charges after finding that the prosecution story was built on false allegations levelled by a businessman. Special judge R K Gauba also took serious note of complainant Tarun Kalra lying under oath to make up the story and directed chief metropolitan magistrate Sangita Dhingra Sehgal to register a complaint against him for falsely alleging that the officer had taken illegal gratification from him for restoring power to his factory.
"It is indeed disturbing that the complainant lodged a report, which was based on false accusations about demand of illegal gratification by the accused... He has revealed the falsity of his own complaint in the course of his own statement as a prosecution witness," the court said. For the offences under section 199 (false statement made in declaration which by law receivable as evidence) and 211 (false charge of offence made with intent to injure) of IPC, a separate complaint has been prepared and sent to the court of the CMM for appropriate action against the complainant in accordance with law, it added in the order. Complainant Tarun Kalra alleged that Delhi Vidyut Board area inspector K L Sharma had demanded bribe of Rs 5,000 on September 3, 1998 from him to repair a cable for restoring electricity supply to his factory at Naraina Industrial Area in West Delhi.
Tarun's father - a witness - also did not support the allegations of demand of bribe by the accused, the court said. Bureau Report
