Mumbai, Dec 25: Assistant Police Inspector G W
Jadhav of Mumbai crime branch, arrested by the special
Investigation Team (SIT) for his alleged complicity in the
fake stamps scam, was remanded to police custody till December
30, today.
The SIT, which arrested Jadhav last night, produced him
in the court of magistrate P P Suroshe today.
Public prosecutor Nagarale, while seeking police custody
of API Jadhav informed the court that the police official did
not initiate steps to arrest scamster Abdul Karim Telgi, in
1995 even after Telgi's anticipatory bail plea was rejected by
a court.
API Jadhav, the court was told, was attached to the
Economic Offence Wing (EOW) of the crime branch then.
Defence counsel, advocates I P Bagaria and Nikita Ajwani,
while opposing police custody remand said that section 161 (1)
of the bombay police act stated that "if an offence in excess
of colourable duty is committed by a police officer and a
complaint is not filed within two years by the state, then no
prosecution can be launched."
The SIT is investigating 15 cases involving Telgi which
were registered by the Mumbai police, but where concerned
investigating officers are suspected to have acted soft. This
is the third such case where SIT has arrested a concerned
police officer, sources said.
