New Delhi, Feb 10: Vikas and Vishal Yadav, son and nephew of Rajya Sabha MP D P Yadav, accused in the kidnapping- cum-murder case of business executive Nitish Katara, today contended before the Delhi High Court that there was no direct evidence to show their complicity in the crime and police was relying on the circumstantial evidence. While Vikas's counsel K N Balgopal contended before Justice R C Chopra that the abduction charge against the accused was wrongly levelled, senior advocate Rajender Singh appearing for Vishal said that evidence against his client has been snapped.
The prosecution theory that Vishal was along with Vikas when the crime was committed is snapped as the statement of D P Yadav's guard at his official residence in Delhi states that only Vikas and the other man presumed to be Katara left for Ghaziabad by Tata Safari car, Singh said during the arguments for quashing of charges against the accused persons.
The trial court has framed charges against the duo for abducting and murdering Katara and destructing the evidence.
Vikas's counsel submitted that the charge of abduction under section 364 IPC could not be attracted against the accused as police has not come out with the evidence that the victim was taken with them forcefully or with deceit means.
Vishal's counsel said the confessional and disclosure statements of his client was an inadmissible evidence as there is nothing on record to suggest that he accompanied the co-accused and victim from Delhi to Ghaziabad.
Police has alleged that the accused had kidnapped Katara from a marriage party in Ghaziabad and murdered him on Feb 17 last year as they did not liked his friendship with their sister. Bureau Report
