Chennai, Aug 06: A legal notice was today sent to the Tamil Nadu police to immediately shift Tamil National Movement (TNM) leader P Nedumaran, lodged in Cuddalore prison since his arrest here on August 1 under Pota, to Central Prison, Chennai, on health grounds. The TNM leader was taken into custody and remanded to judicial custody till August 28, by a designated Pota judge, for a "pro-LTTE" speech at a 'Tamils right to live conference' here on April 13 last. Stating that if anything untoward happened to Nedumaran due to his ill health the police would be held squarely responsible for it, the leader's advocate N Chandrasekaran said if he was not shifted to Chennai prison as per the orders of the Pota judge he would be constrained to take legal action.
The judge had directed that he be lodged at the Central Prison after a plea was made to keep him here in view of his age and ill health, the notice pointed out.
The advocate said that after taking Nedumaran to the Chennai jail the police team, which had taken him into custody, following discussions with Central Prison authorities, decided to lodge him in Cuddalore Jail.
He said that he had informed the judge that his client suffered from a heart ailment, had undergone bypass surgery recently at a corporate hospital and that he was undergoing periodical medical cup here.
Besides, the notice said, failure to detain Nedumaran in Central Prison amounted to contempt of court.
