Lucknow, Feb 25: In a major relief to Uttar Pradesh Chief Minister Mulayam Singh Yadav and 11 others in the state guest house case, the Lucknow bench of Allahabad High Court has dismissed an appeal by the state challenging a sessions court order that no case was made out against the accused under the Prevention of Corruption Act. Justice N K Mehrotra, while delivering the reserve verdict yesterday, observed in his 16-page order that there was no illegality or impropriety in the findings of the sessions judge to the effect that no offence under Section 13(1)(D) of the Prevention of Corruption Act was committed by any of the accused. The Sessions Judge, Lucknow, on May 28, 1997, had withdrawn the earlier order of taking cognizance of the offence under various sections of the Indian Penal Code. After investigating the much publicised guest house case the CB-CID had filed chargesheets against 67 persons including Yadav under various sections of IPC and Section 13(1)(D) of Prevention of Corruption Act as well as Section 7, Criminal Law Amendment Act. Justice Mehrotra said, ''By an overall assessment of the evidence collected during the investigation, at the most it appears that it was an attempt to carry out a split in the BSP and an attempt to generate a split in a political party is not an offence. Therefore, there can be no question of conspiracy.'' It was further observed that ''There is no evidence at all that either Yadav or any of the opposite parties, at the time of holding the post of public servant, either directly offered or paid any valuable thing or themselves obtained any pecuniary advantage.''
