New Delhi, Feb 21: The Delhi High Court today asked the CBI to take up with the Centre again the issue of sending a commission to record the evidence of former US Congressman Marvin M Dymally in 17-year-old Lakhubhai Pathak cheating case in which former Prime Minister P V Narasimha Rao and self-styled Godman Chandraswami are facing trial.
Stating that an accused under law had a fundamental right to get every opportunity to defend himself in a criminal case, justice R C Chopra directed CBI counsel A K Dutt to pursue the matter with home ministry again.
Though a treaty between US and India was on the final stage of its conclusion, the commission could not yet be sent to America its ratification, CBI counsel informed the court. Bureau Report
