New Delhi, Dec 02: Asserting that issuance of notice
by the POTA review committee amounted to interference with the
course of justice, the Tamil Nadu government today challenged
its jurisdiction for going into the detention of MDMK supremo
Vaiko and Tamil daily Nakkheeran's Editor R R Gopal under the
stringent anti-terrorism law.
In reply to the show cause notice on the two cases, the
Tamil Nadu government in its affidavit, filed before the
commission, raised "preliminary objection" on its
jurisdiction, contending it was not authorised by any
statutory power to go into the matter when charges have been
framed by the special court.
"The trial is going on after framing of the charges. It may not be appropriate for the review committee to go into the matter at this stage as the criminal court has applied its mind and then decided to frame charges and go ahead with the trial," senior advocate C S Vaidyanathan, who appeared for the Tamil Nadu government, said after filing the affidavit.
