New Delhi, Mar 11: The Supreme Court today said a three-judge bench would on April seven fix a date for hearing a petition filed by CBI challenging the Delhi High Court order quashing the chargesheet filed against three Hinduja brothers in the Bofors payoff case.
A five-judge constitution bench headed by chief justice V N Khare said that the matter would be heard by a three-judge bench presided over by Justice S Rajendra Babu.
Appearing for Hindujas, senior advocate Ram Jethmalani requested the Apex court to direct the Delhi High Court to expeditiously dispose of two petitions of his clients challenging framing of charges against them.
He said as there was no evidence against the Hinduja brothers to link them to the Rs 64 crore payoff case, expeditious disposal of the petitions pending there would be a step forward in the decade-old case.
Appearing for the CBI, Solicitor General kirit raval strongly opposed the plea saying the Apex court should not interfere in the petitions pending before the High Court. The Apex court then declined to pass any order on the plea.
