New Delhi, Feb 02: The Delhi High Court has issued notice to city government and MCD on a petition alleging that dumping of garbage around a rehabilitated colony by civic authorities has made the area unfit for healthy living. Directing the authorities to clean up the area and make it pollution-free and non-hazardous, a bench comprising Justice Usha Mehra and Justice Pradeep Nandrajog sought reply from them and fixed the next hearing on the issue for March 7.

The Public Interest Litigation (PIL) filed by society for Securing Justice (SSJ), had alleged that Municipal Corporation of Delhi (MCD) was dumping the garbage collected from various parts of the city in the surroundings of Swamy Shradhanand colony in North-West Delhi endangering life with diseases like malaria, dengue etc. The SSJs counsel A K Srivastva submitted that due to the serious ommission and manifest conduct on the part of civic authorities in not providing healthy environment, there is a serious abridgement of the fundamental rights of the people of the locality. Alleging that due to improper sewerage system water logging has become a permanent feature, the PIL claimed the MCD installed bio-fertilisers plant in the colony which uses garbage as raw material causing air pollution.

The burning of garbage and resultant poisonous smoke is causing acute cough, asthama and bronchitis problems to the people who were rehabilitated from slums, the SSJ submitted. The petitioner said despite several representations, the civic authorities have not taken steps to provide residents a pollution-free, healthy and hygienic life.
