Order on bail application of 11 Godhra accused on October 17
Ahmedabad, Oct 14: The special Pota court today reserved its order for October 17 on a regular bail application filed by 11 accused in Godhra train carnage case.
Ahmedabad, Oct 14: The special Pota court today reserved its order for October 17 on a regular bail application filed by 11 accused in Godhra train carnage case.
Arguments on the matter by advocates L R Pathan and Y A Charkha, representing the 11, and special public prosecutor H M Dhruv concluded here at the court of Pota judge Sonia Gokani.
The regular bail application moved under Section 439 of IPC stated that the investigating agency had falsely arrested the accused in connection with the train carnage.
Charkha said the 11 were actually arrested for curfew violation and then were charged for being part of the mob that attacked the S6 coach of Sabarmati Express on February 27.
SPP H M Dhruv said that the accused were allegedly part of the mob that attacked the ill-fated coach and there was a prima facie case against them as they were armed even if they did not personally attack the coach along with several others in the mob.
The prosecution lawyer added that the charges levelled against one of the eleven accused, Mohammed Hussain Kalota, a former Congress corporator from Godhra, were more serious and that he allegedly provoked the mob to attack the coach.
Over hundred twenty-five persons were named accused in the case, including those absconding, and Pota charges were slapped on them.
