Mumbai, Jan 29: Bombay High Court today stayed till February nine the execution of a bailable warrant issued by a lower court against Bollywood actor Shah Rukh Khan in a case of alleged cheating and criminal breach of trust filed by an estate agent. Justice Dilip Bhosale, granting an ad-interim stay on the warrant issued on January 22 by Additional Chief Metropolitan Magistrate J B Phanke, posted the hearing on the matter to February 9. The Addl CMM had directed the actor to appear before the Bandra Metropolitan court on March 11. The warrant was issued in response to a January 13 complaint filed by agent Anees Ahmed alleging he was duped to the tune of Rs 3.81 lakh by the actor, who had not paid his ''brokerage'' on a property deal. Shah Rukh, who was not present in the court today, was represented by senior advocate Shirish Gupte, who denied the charges levelled by the agent. He said to purchase the property here, Shah Rukh had approached broker Ramesh Patel. He said Patel had introduced the actor to Ahmed, who was the broker from the property owner's side.
Advocate Gupte told the court that it was not agreed to pay two per cent brokerage on the property deal as claimed by Ahmed.
The court was informed that Shah Rukh's broker Patel had suggested to pay some amount to Ahmed so that the latter would be helpful in expediting the transfer procedure within two months.

Accordingly, the payment was made, but till date the property had not been transferred in the actor's name, advocate Gupte said.
He said the estate agent had started making ''false, dishonest and malicious'' statements against the actor to various newspapers and TV channels to tarnish his image.


''Shah Rukh Khan was not served any paper related to the complaint, nor was he summoned by the lower court. The court had directly issued a bailable warrant against him. This was purely a civil dispute without having any element of criminal intent in it. The magistrate has exceeded his jurisdiction and is guilty of non-application of mind,'' Shah Rukh's counsel alleged.
He urged the court to stay the operation of the warrant till the disposal of the petition. Bureau Report
