Mumbai, Dec 10: A sessions court today reserved until tomorrow its order on the bail plea of a Swiss couple, arrested two years ago for allegedly abusing children in
pornographic acts.
The order was reserved by sessions Judge S B Munde who heard arguments advanced by the accused and prosecution. Wilhelm Albin Marty (59) and his wife Mary Lily Marty (56) allegedly lured children into pornographic acts by offering them good food and clothes and sold the obscene film and photographs to websites all over the world. The duo were arrested on December 16, 2000, from a five star hotel here. The accused pleaded for bail on the ground that they were in custody for two years and would not abscond if granted bail. Prosecutor R V Kini opposed their bail on the ground that they were foreign nationals and would abscond if granted bail. He said their bail had been rejected on merits on January 15, 2000 and since then there has been no change in circumstances.
The prosecutor further said that the couple had been charged with section 367 IPC (kidnapping for purpose of committing unnatural offence) which was a non-bailable offence.
It was submitted that at the time of their arrest, four nude children were found from the hotel room. They have turned witnesses and told the police about alleged offences committed by the accused. Police had filed chargesheet against the accused in February this year.
