New Delhi, May 04: A Delhi court today charged Delhi Police officer D P Singh with murdering a minor boy during the anti-mandal agitation of 1990 by firing on his forehead from his service revolver. "On September 25, 1990, at about 11.45 am near I avenue, Sarojini Nagar, you fired a bullet from your service revolver which hit Aditya Narain Sharma on his forehead as a result of which he died on October 17, 1990 and you thereby committed the offence of murder punishable under section 302 IPC," said Additional Sessions Judge J M Malik.

The court alternatively charged Singh under Section 304 II (culpable homicide not amounting to murder – without intention to cause death) and fixed May 13 for recording prosecution evidence.

The incident dates back to September 25, 1990 when 15-year-old Aditya Narain was shot on the head near Sarojini Nagar bus depot where a crowd had allegedly gathered to protest the Mandal Commission Bill.
Narain later succumbed to his injuries.

Later, his father R N Sharma filed a complaint in court alleging that the shot was fired by Singh, who was then a sub-inspector. Forensic tests also established that the bullet which hit Narain had indeed come out of Singh's pistol.
Sharma claimed that his son was not part of the unlawful assembly and hence Singh was not entitled to protection of laws applicable in the event of discharge of official duties.


The complainant also sought legal action against the then DCP Deepak Mishra, but proceedings could not be launched against him as police failed to obtain the requisite sanction to prosecute him.
