On board special aircraft, Sep 23: Prime Minister Atal Bihari Vajpayee will decide on Tamil Nadu chief minister Jayalaithaa's demand for removal of central minister M Kannapan from the government on his return from abroad, Deputy Prime Minister L K Advani said today but maintained that allegations cannot be just made against state governments on misuse of Pota. "We cannot level allegations against any particular state government of misusing Pota. Cases are before the court and let the court decide," he told reporters accompanying him to Bastar about Jayalalithaa's demand contained in a letter to the Prime Minister yesterday. He said that MDMK leaders also met him yesterday and discussed the issue.

It was upto the Prime Minister to give his views on Jayalalithaa's letter, he said.

While the act was enacted by the Centre, its implementation is only vested with the state governments, he said.
"While all CrPC, IPC and Pota are enacted by the Centre, its implementation is only with the state governments,” he said.

Asked about MDMK leader Vaiko, who is in jail for over a year under Pota, Advani said the Centre has filed two affidavits before the court saying, the case was not fit for Pota.
Advani said that while enacting Pota, the Centre had assured it would not be misused and that was till date. "No one can accuse the Centre of misusing Pota", he asserted.
