The Supreme Court will decide on Friday a plea of one of the Hinduja brothers, accused in the Rs 64 crore Bofors payoff case, to go abroad to join his two other brothers to look after their business interests in view of the sudden global recession.
The application of G P Hinduja was posted before a bench of justice M B Shah and justice B N Agarwal.

Kapil Sibal, appearing on behalf of Mr Hinduja contended that his client's presence abroad was urgently required due to the changed scenario in their global business after the September 11 attacks.
CBI counsel N Natarajan vehemently opposed the plea saying that the apex court had already permitted two of the Hinduja brothers to leave the country and they can take care of their business interests.

The special court, trying the Bofors case, the CBI counsel said, was yet to frame charges against the Hinduja brothers and the present application of G P Hinduja could be decided thereafter.

At this stage Sibal intervened to say that his client had always cooperated and complied with the directions of the court and thus there was no apprehension that Hinduja's would not come back to face the trial.
