New Delhi, Nov 21: The Delhi High Court today
allowed Kalyan Singh's plea for restoration of his earlier
petition against his summoning by the Liberhan Commission and
asked it not to take coercive steps to force the former Uttar
Pradesh chief minister to appear before it as a witness till
the petition was disposed of.
Reviving Kalyan Singh's petition challenging his
summoning, Justice A K Sikri fixed December 05 to hear the
matter on merits.
"One should not be hyper-technical. After all it involves a question of substantial justice," Justice Sikri said in his order.
Kalyan Singh has so far refused to depose before the commission as a witness on the ground that it would adversely affect his defence in the criminal case relating to the demolition pending in CBI court in Uttar Pradesh.
The petition revived today was earlier dismissed as "infructuous" on April one last after conclusion of recording of evidence by the one-man panel probing the sequence of events leading to the demolition of disputed structure at Ayodhya on December 1992.
