New Delhi, June 20: Supreme Court has issued notice to the Gujarat government on a Special Leave Petition filed by an accused in the Godhra Sabarmati Express burning case, who challenged his detention under Prevention of Terrorism Act. A vacation bench of the apex court comprising Justice R C Lahoti and Justice Brijesh Kumar issued notice after hearing Colin Gonsalvez, the counsel for the accused Maulana Umarji. The SLP was filed against the Gujarat High Court order, which had confirmed the police remand of Maulana Umarji passed by a Pota court. The High Court had earlier upheld the view that under the provisions of Pota, police could be permitted to get the custody of the accused even after the expiry of the period of 30 days from the date of arrest, Gonsalvez said and contented such an interpretation was violative of Article 21 (Right to Life and Personal Liberty) of the Constitution of India.
