The Delhi High Court on Tuesday gave liberty to Janata Party president Subramanian Swamy to split various issues raised by him in his petition seeking probe into Congress president Sonia Gandhi and her family's alleged links with a foreign intelligence agency for monetary and pecuniary consideration. A division bench comprising justice Devinder Gupta and justice S K Kaul allowed Swamy to file fresh writ petition or petitions within two weeks by splitting the issues, which according to the petitioner warrant cause of action in the matter. Clarifying that it was not making any observation on the merit of the case, the court told Swamy that the list of dates in his present petition is so confusing that it does not make the issues clear.
“We have gone through it and found that cause of action sought by you is not clear. Please clarify the cause of action,” the bench told Swamy. There should be separate petition for separate cause of action on separate issues, The bench observed after a brief hearing on the Public Interest Litigation (PIL) by Swamy.
Swamy, in the PIL, alleged that congress had paralysed the proceedings of parliament in order to obtain a commitment from the government to block an inquiry by the CBI and other agencies allegations into the logical conclusion.
