New Delhi, Aug 04: Government today told Rajya Sabha
that it has no intention of filing any review petition on the
Supreme Court's judgement in the case relating to an amendment
of the electoral law on disqualification of a candidate in the
elections.
"The judgement of the Supreme Court is final. The
judgement pronounced by it is now the law of the land," law
minister Arun Jaitley said during question hour.
Jaitley said the court was of the view that the
qualification regarding assets and educational requirement
should be scrutinised prior to allowing the candidate to file
nomination while the government felt this should be done
later.
The court in its judgement on March 13, 2003 held that
Section 33B of Representation of People Act, 1951 under the
Representation of People (third amendment) Act, 2002, was
violative of Article 19 (1) (A) of the constitution, Jaitley
said.
