New Delhi, Sept 09: Aggarwal and Modi Enterprises Pvt Ltd, which runs chanakya cinema complex in the capital, has challenged a single judge bench order of the Delhi High Court directing the company to hand over possession of the premises to its owner - the NDMC. A division bench comprising Chief Justice B C Patel and Justice A K Sikri sought certain information on the agreement between the parties and alleged sub-letting of the premises by the appellants and fixed on Monday for further hearing.

However, the single judge bench order has not been stayed.


Earlier, Justice Mukul Mudgal had on August 8 ordered Aggarwal and Modi Enterprises Pvt Ltd (cinema projects) to vacate the NDMC-owned Chanakya Cinema complex by September 30.

However, while refusing to renew the lease in favour of the appellants, Justice Mudgal had given it time till September 30 to vacate the complex subject to the company submitting an undertaking that it will vacate the same by that time.

The company, in possession of the complex since 1970, was initially given the possession for 10 years and it got two renewals of 10 years each.


Thereafter, it continued to be in possession of the complex, built by NDMC in 1960, by virtue of various court orders.
