Mumbai, Mar 10: In a fresh development in the case of alleged BNollywood nexus with underworld, prime accused and film financier Bharat Shah today decided not to press his petition in a special court urging for disregarding evidence with regard to interception of alleged telephonic talks between him and Pakistan-based gangster Chhota Shakeel. Shah's lawyer Vibhav Krishna told designated judge A P Bhangale that he would like to defer the petition until the entire evidence was led by the prosecution.
Accordingly, designated judge A P Bhangale disposed of Shah's petition but granted him liberty to move the court after the evidence was adduced.


Shah had moved the special court urging for disregarding evidence in view of the High Court order striking down the provisions of interception of telephonic talks under Maharashtra Control of Organised Crime Act (MCOCA).


In a related development, the Supreme Court today issued notice to Maharashtra government on a petition filed by Shah urging for discharge on the ground that trial court had erred in framing charges against him. The notice is returnable within four weeks. Shah had challenged an order of trial judge A P Bhangale, who had framed charges against him for threatening film personalities including Hrithik Roshan and Shah Rukh Khan and conspiring with others to murder them. Shah questioned the framing of charge of murder (Section 302 IPC) on the ground that it was `absurd' as these personalities were still alive.
