New Delhi, Jan 14: The Delhi High Court today pulled up CBI for filing incomplete interpol report in connection with a case filed by Janata party president Subramanian Swamy against congress president Sonia Gandhi and asked the agency to file a complete report by January 21. During hearing of a PIL filed by Swamy seeking registration of an fir against Sonia Gandhi on his complaint, a bench of Chief Justice B C Patel and Justice B D Ahmed termed the CBI's report as one filed "half-heartedly". Last week the agency had told the court that there was no sufficient material to proceed against Gandhi on Swamy's allegations. The bench also asked the CBI to file reply to Swamy's plea seeking a copy of the interpol report by the next date.
The court asked the CBI to file an affidavit claiming privilege over the report after senior counsel P P Malhotra, who appeared on behalf of the agency, submitted that the report could not be shown to or shared with the petitioner. The direction came after the bench sought the interpol report from the CBI and perused it only to find that it was not a complete report. Swamy had sought direction to CBI to give a copy of the said report to him in order to assist the court properly. Accusing CBI of not conducting proper inquiry into the matter of alleged smuggling of antiques, Swamy cited the case of one Zanderigo Guido in which all the accused were acquitted due to "shoddy" probe by CBI.
