Chennai, Feb 10: A designated Pota court today issued notice to 'Q' branch of Tamil Nadu police on a memo by counsel for Pota detainees, MDMK chief Vaiko and eight others, seeking certain documents, listed as material objects in the case against them under the anti-terrorist law. Directing the state public prosecutor to take the notice, designated Pota Judge L Rajendran posted the case for hearing on February 28.
The judge also fixed the same day for hearing and viewing audio and visual tapes included as part of the chargesheets, on another memo by advocates for the accused, who claimed that this was necessary to verify if the extracts were genuine.
Besides, their clients would give them instructions only after seeing and listening to the cassettes, the lawyers said.
The viewing would be held 'in-camera'.
When asked pointedly by the judge whether the defence was entitled for copies of material objects, the counsel replied in the negative but pointed out that in the present case, section 207 Cr.Pc could be invoked as portions of documents listed as material objects were to be relied upon by the prosecution in the case.
