New Delhi, Mar 10: Delhi High Court today quashed the promotion of about 140 law students of Delhi University on the ground that it was made in violation of rules. Quashing their promotion, a bench comprising Justice Usha Mehra and Justice Pradeep Nandrajog said, "If the present state of affairs continues in the University of Delhi, this (learning) may well be the epitaph of the faculty of law." "In the matter of education no court can permit total violation of the norms, LL.B degree course is expected to produce trained legal minds ready to take on the challenges of the 21st century. Decline in educational norms in the profession of law courses was noted even by the Supreme Court," it said.
The promotion of the students from LL.B part-I and part-II last year was challenged by professor S N Singh, in-charge of law centre-II, alleging that the university had completely overlooked its own rules in this regard. As per the rule, a student passing five papers in the LLB part-I and 15 papers in part-II will be eligible for promotion to the second and final years respectively.
However, the university had even promoted those students who had passed only in four papers in first year and 14 papers in second year, Singh in his petition said. "Whatever be the equities, we cannot permit a total violation of the norms. Promotion of all students who have cleared only 4 or 14 papers respectively to the third term and fifth term are thus quashed," the court said in its verdict.
