HC reserves judgement on implementation of CAS in capital

Reserving the verdict, a bench Comprising Chief Justice B C Patel and Justice A K Sikri asked the Centre to file by tomorrow written submissions and records containing the decision to defer Conditional Access System (CAS) in the city.
The petitioners including Zee promoted Siti Cable Network, Cable Network Association (CNA) and others have challenged the Centre's August 29 notification deferring indefinitely the implementation of CAS in the capital from September 1 contending that it was unconstitutional, illegal, arbitrary and contrary to public interest.
They alleged that CAS was deferred in the capital for political considerations undermining public interest.
Denying the allegations, Additional Solicitor General (ASG) K K Sud said CAS has been temporarily deferred in the capital and the Centre was not averse to its implementation.
"There was no political consideration for deferring CAS but in view of the political situation and apprehension of law and order problem it has been temporarily deferred," he said.

The ASG said implementation of CAS was deferred as a large number of government officials would be engaged in the electoral process for the coming assembly elections. In that case it would become difficult to enforce the scheme, he added.
Earlier, senior advocate Harish Salve, appearing for the petitioners alleged that deferring the implementation of CAS was an open and shut case of abuse of power by the Centre.
