Jabalpur, Sept 18: The Madhya Pradesh High Court today dismissed a petition by Muslim leaders challenging the government's orders to open the controversial Bhojshala at Dhar every Tuesday, observing that the matter did not fall under its jurisdiction.
Justice A K Mishra in his order observed that matters involving disputed facts could not be decided by the high court by invoking Articles 226 and 227 of the Constitution in the writ jurisdiction.
After preliminary hearing, the judge dismissed the writ petition filed by a group of Muslims including Shahar Kazi Zakaulla of Dhar, seeking quashing of government orders of April 7, 2003 to allow Hindus to visit Bhojsala every Tuesday with flowers and grains of rice. Counsel for the petitioners, Sobha Menon told a news agency that an appeal would be made on the matter to the division bench.
