SC extends stay on Teesta Setalvad`s arrest till Dec 5
The Supreme Court on Wednesday extended the interim bail granted to Teesta Setalvad till December 6.
New Delhi: In a big reprieve for social activist Teesta Setalvad, the Supreme Court on Wednesday extended the interim bail granted to her till December 6.
The apex court also extended the interim bail granted to Setalvad's husband Javed Anand till the next hearing in the case.
This implies that the police cannot arrest Teesta Setalvad and her husband until December 5 when the mater will come up for hearing again.
Teesta had moved the Supreme Court after the Gujarat High Court had refused to grant them anticipatory bail.
The Gujarat High Court had rejected their plea on the ground that they were not cooperating with the investigations.
The Gujarat police had booked Teesta and her husband on charges of breach of trust, cheating for misusing funds.
The case in question was relating to the construction of the Museum of Resistance in the Gulbarg society at Ahmedabad.
Many persons had complained that in the name of constructing this museum funds had been misappropriated by Teesta and her husband. The alleged misappropriation was to the tune of Rs 1.51 crore.
The Supreme Court had on Monday termed as "mistake" its earlier order extending interim protection from arrest granted to Teesta Setalvad and her husband, indicating that the relief was granted by a two-judge bench earlier instead of three.
"Earlier, it was a mistake," a bench comprising justices A R Dave and Adarsh Kumar Goel observed when senior advocate Kapil Sibal, appearing for the activist, said the protection against arrest was expiring on October 15 and moreover, last time this two-judge bench had itself extended the relief.
"It is a three-judge bench matter... place it before the appropriate bench," the court said and asked Sibal to mention it before the Chief Justice for making available the special bench to extend the relief.
