Man accused of killing brother acquitted for lack of evidence
A sessions court today acquitted a man, accused of killing his brother, for lack of evidence and the prosecution`s failure to prove the case against him.
Mumbai: A sessions court today acquitted a man, accused of killing his brother, for lack of evidence and the prosecution`s failure to prove the case against him.
According to the prosecution, accused Pramod Gautam (24) killed his brother Rajesh in 2011 as the latter had refused to pay money to him.
Rajesh and five others used to stay in the same house in Sakinaka in suburban Mumbai and worked in the same factory.
On November 2, 2011, Rajesh came home early as he was not feeling well. After some time, Rajesh`s uncle (who was his employer and the landlord of the house) came to meet him. When his uncle was leaving the place, Pramod asked him how much money he gave to Rajesh. After their uncle left, there was an argument between the two over money, following which Pramod assaulted Rajesh with a knife, in which he died.
The prosecution examined 14 witnesses to prove their case.
However, defence lawyer Amrish Salunke said the statements of the witnesses were contradictory and the motive of the murder was not proved. Salunke further argued it was in fact Pramod who took the deceased to four different hospitals (as the first three hospital denied admission). However, he was declared dead on admission by the government-run Rajawadi hospital.
The court accepted Salunke`s arguments and acquitted Pramod.
