Notice to Centre on plea challenging WFI election
The Delhi High Court asked the Centre and the Wrestling Federation of India (WFI) to respond to a plea challenging the election in the sport body.
Justice Vipin Sanghi, who recently quashed election of the President of WFI and ordered a fresh poll to the post in two weeks, fixed the case for hearing on January 27.
The court was hearing the petition of Narinder Mahajan
who has sought quashing of election of two other office
bearers of the sports body. He cited the earlier judgement of
Justice Sanghi in support of his plea.
The court had on January 4 said that though it had
quashed the election of the President only, others may also
dispute the election of other office bearers of WFI.
Meanwhile, Justice Sanghi today refused to stay the
notification issued by the WFI for election of its President
on January 29 and said the poll process has begun in pursuance
of his earlier judgement on the issue.
The court, however, said Justice C K Mahajan, a former
judge of the Delhi High Court, who is appointed Returning
Officer for holding the poll, would deal with "claims and
counter-claims on voting rights of members of the electoral
college."
It rejected the plea of WFI that the guidelines of the
Ministry of Sports provides that the office-bearers of the
sports body would decide the voting rights of the members.
The Returning Officer has no role in scrutinising the
members of the electoral college, WFI said.
"The Returning Officer will decide the eligibility of
voters. In case, he cannot decide it within two days, then he
will keep his findings in a sealed cover which could be opened
after the election," he said.
