New Delhi, Dec 18: The Supreme Court is likely to give its judgement in on a special leave petition by the Maharashtra government challenging a Bombay High Court order dropping the charge of culpable homicide not amounting to murder against filmstar Salman Khan in a hit and run case. On December 16, the court had reserved its judgement in the case till today. The judgement was reserved by a bench of Justice N Santosh Hegde and Justice B P Singh on the conclusion of arguments from both sides.

Earlier, senior counsel Ashwini Kumar appearing for the Mahasrashtra government contended that Salman Khan was driving without license at a speed of 100 km per hour under the influence of liquor knowing fully well the consequences of his actions. One person was killed and three others were seriously injured in the accident. The trial court therefore rightly framed the charge of culpable homicide not amounting to murder under Section 304 (part 2) of the Indian Penal Code, he submitted. The high court erred in dropping the charge of culpable homicide not amounting to murder on September three this year, he said.

On the basis of the facts of the case it was pre mature on the part of the high court to reach such a conclusion , Justice Hegde observed.

The court directed that the trial of the case will continue without being affected by the order of the high court. Bureau Report
