Monopolies and Restrictive Trade Practices Commission (MRTPC) has given a clean chit to Food Specialities Ltd. (FSl) while dropping notice of inquiry into alleged unfair trade practices in the free gift sales promotion scheme for its popular 'Maggi' noodles. Discharging notice of inquiry earlier issued by the commission, the two-member bench Sardar Ali and R L Sudhir said that no case of unfair trade practice was made out against the respondent company and hence the complaint fails. The complaint filed by a Delhi resident Sunil Kumar had alleged that FSL, which is now known as Nestle India, had launched a free gift scheme and simultaneously increased the price of the Maggi noodles pack. The director general (investigation and registration) which was directed to probe the issue, submitted in its preliminary investigative report to the commission that the free gift scheme launched by FSL was misleading as the cost of gift was partly recovered from the consumer. But, the bench said that no loss or injury was caused to the consumers on account of this scheme, and that the respondent was able to make out a convincing case for increasing the price of Maggi noodles before launching the free gift scheme. It was wrong to attribute that the gift scheme was introduced with an intention of not providing the gifts free of charge, informed the bench. Bureau Report
