Court orders registration of FIR against police personnel

A Delhi court has ordered registration of an FIR against four police officers, including an SHO, for allegedly confining a man in police station for daring to lodge a complaint against them.

New Delhi: A Delhi court has ordered
registration of an FIR against four police officers, including
an SHO, for allegedly confining a man in police station for
daring to lodge a complaint against them.

Metropolitan Magistrate S P S Laler directed the lodging
of the criminal case against SHO of R K Puram Manmohan Ralhan,
Traffic Inspector Vishwanath, Assistant Sub Inspector
Sribhagwan and Head Constable Prem Singh.

The order of the court came on May seven on a complaint
filed before it by Munish Kumar Gaur who alleged the four
police officials had entered into a criminal conspiracy and
caused hurt to him after wrongfully confining him in the
police station as he wanted to lodge an FIR against them for
allegedly indulging in corruption.

The court asked the Deputy Commissioner of Police (DCP)
concerned to refer the case for investigation to an officer
who was higher in the rank to the SHO so that the "probe is
not unduly influenced".

"A perusal of the complaint and documents discloses the
commission of a cognisable offence and investigation by police
is required to find out the truth behind the allegations which
included that of corruption as well," the court said.

It also noted it is a settled principle of law that the
police is bound to lodge an FIR as and when a complaint
alleging cognisable offence is made out to them.

According to Gaur, he was detained at R K Puram police
station for nine hours on the intervening night of April 29
and 30 by the SHO as he wanted to lodge an FIR against traffic
police personnel.

His complaint alleged he, along with his wife, was going
to their office on the morning of April 29. He saw Head
Constable Singh and ASI Sribhagwan signalled a blueline bus
which applied brake suddenly, causing traffic jam and even
accident with his car by another private bus.

Gaur claimed when he and his wife requested the police
personnel to chase the private bus, the traffic police
personnel started abusing him and his wife.

He alleged when he and his wife went to the police
station to lodge a complaint against the traffic police
personnel, the police officer first refused to listen and
later instead lodged a case against him to harass him.
