New Delhi, Feb 21: The Delhi High Court today asked
the CBI to take up with the Centre again the issue of sending
a commission to record the evidence of former US Congressman
Marvin M Dymally in 17-year-old Lakhubhai Pathak cheating case
in which former Prime Minister P V Narasimha Rao and
self-styled Godman Chandraswami are facing trial.
Stating that an accused under law had a fundamental right
to get every opportunity to defend himself in a criminal case,
justice R C Chopra directed CBI counsel A K Dutt to pursue the
matter with home ministry again.
Though a treaty between US and India was on the final
stage of its conclusion, the commission could not yet be sent
to America its ratification, CBI counsel informed the court.
