Khalid will remain in jail as he is accused in some other cases, including one related to the criminal conspiracy lodged under stringent Unlawful Activities (Prevention) Act. The court noted that even the CDR location of the mobile phone of applicant was not found at the scene of crime on the date of incident. The bail was granted on furnishing a Personal Bond in the sum of Rs 20,000 with one surety in the like amount.
Chief Metropolitan Magistrate Pankaj Sharma on Monday took cognisance of the offences -- 124A (sedition), 323 (voluntarily causing hurt), 465 (forgery), 471 (using forged document), 143 (punishment for unlawful assembly), 149 (member of unlawful assembly), 147 (rioting) and 120B (criminal conspiracy). Cognisance has been taken exactly one year after the Delhi government granted sanction to the Delhi Police to prosecute the accused, on February 27, 2020. The final pages of the charge sheet also confirm the presence of Kashmiri students during the protest and that they were in contact with Umar Khalid.
In connection with North-East Delhi violence, Delhi Court extended the judicial custody of accused including Umar Khalid, Sharjeel Imam, Asif Iqbal Tanha The Court in November 2020 said that there is sufficient material to proceed against accused Khalid, Imam and Khan for offences under provisions of UAPA. More than 750 cases were registered over the northeast Delhi violence, in which at least 53 people were killed and several others were injured.
