Decide 1984 riots victim`s case for flat allotment: HC to DUSIB

The Delhi Urban Shelter Improvement Board (DUSIB) has been asked by Delhi High Court to decide a 1984 riots victim`s case for allotment of a flat under the applicable scheme established for such persons.

New Delhi: The Delhi Urban Shelter Improvement Board (DUSIB) has been asked by Delhi High Court to decide a 1984 riots victim`s case for allotment of a flat under the applicable scheme established for such persons.
Justice V K Jain directed DUSIB to process Sardar Gurmukh Singh`s application for allotment, according to the applicable scheme and by considering him as a 1984 riots victim, within two months and disposed of his petition. The court passed the order on the petition of the riots victim whose house and shop were set on fire by rioters, but he was not alloted a flat despite existence of a scheme for this purpose. Singh in his plea had contended that his application for allotment of flat was rejected in 2012 by DUSIB on the ground that his name was not found in the list of eligible 1984 riot victims for allotment of flat. However, Delhi government informed the court that Singh was a victim of the 1984 riots, which occurred in the wake of the assassination of then Prime Minister Indira Gandhi, and he was paid an initial as well as an enhanced compensation for the damage to his property, goods, etc. "The eligibility of the petitioner for allotment of alternative flat, therefore, stands admitted by the government of NCT of Delhi. In view of the aforesaid stand taken by the government of NCT of Delhi, it is no more open to the Board to pass the buck to the said government. "The writ petition is, therefore, disposed of with direction to the DUSIB to process the case of petitioner for allotment of alternative flat, as per the applicable policy, on the basis that the petitioner is a victim of 1984 riots, who was paid compensation by the government. "An appropriate decision, in this regard, as per the policy of allotment of alternative flat to the victims of 1984 riots, shall be taken by DUSIB within eight weeks from today and be conveyed to the petitioner within one week thereafter," the bench said.
