Row over degree: HC notice to AAP candidate, ECI and BCI

Delhi High Court has sought the response of Bar Council of India, the poll panel and an AAP candidate for the Delhi assembly polls, on a plea alleging that he got himself enrolled as an advocate on the basis of a "false and bogus" graduation degree.

Justice Rajiv Shakdher issued notices to Tomar, Bar Councils of India and Delhi, Election Commission of India, and the universities from where the Aam Aadmi Party candidate from Tri Nagar constituency, Jitender Singh Tomar, has claimed to have graduated as well as studied law, and sought their replies before the next date of hearing, April 27.

The notices were issued on the plea of an advocate who has alleged that Tomar was not a science graduate from Avadh University, as he has claimed.

The petition also alleged that the Bishwanath Singh Institute of Legal Study College, Munger in Bihar, from where Tomar claims to have studied law, does not meet the standards prescribed by the Bar Council of India.

The petitioner, Santosh Kumar Sharma, has sought initiation of action against Tomar "for filing bogus graduation degree while seeking enrolment with respondent 2 (Bar Council of Delhi)".

Sharma has said he had filed a Right to Information (RTI) application in Awadh University regarding Tomar's degree and a response was received that the AAP candidate was not granted a science degree.

"It is submitted that respondent 2 has granted the enrolment to the respondent 5 (Tomar) without verifying the documents and without application of mind," the petition said.

It also alleged that Tomar had falsely declared on affidavit that he was a practicing advocate while filing his nomination with the poll panel for the 2015 assembly elections in Delhi and has sought directions to the Election Commission of India to take action against the AAP candidate.

The petition has also sought directions to Bar Council of Delhi to cancel Tomar's enrolment as an advocate.
