Divorced women to get share in hubby's property

New Delhi: Amid the opposition demand to make divorce more women-friendly, the government on Thursday approved fresh amendments in a bill pending in Rajya Sabha to give the wife a clearly defined share in husband's immovable residential property.

A meeting of the Union Cabinet, chaired by Prime Minister Manmohan Singh, took up new amendments to the Marriage Laws (Amendment) Bill introduced in the Rajya Sabha earlier this month.

The government also decided to retain the mandatory six-month cooling-off period, which the bill had proposed to do away with in case of divorce with mutual consent.

However, to waive the cooling period, both the parties will have to move the application together.

"In other words, the application to reduce the period can't be moved by one party," sources said after the meeting.

Once the divorce is granted, the woman will have to move an application to get share in her husband's property as part of the settlement.

Keeping in mind the demand of the opposition, it has now been decided to give the wife and children a clearly-defined share in the husband's "immovable residential property" in case of a split.

Sensing the mood of the House, Law Minister Salman Khurshid had deferred his reply to the Bill on May 2 in the Upper House.

"The amendments clarify and amplify provisions to be made in case of divorce," the sources said.

The Law Ministry Bill seeks to further amend the Hindu Marriage Act, 1955, and the Special Marriage Act, 1954.

Cutting across party lines, various members felt the bill was being brought in haste and its spirit went against the interests of women and feared they would lose their rights further if divorce was made easier.

I am also married woman and doing job work but I always think abt. my husband`s future. The divorce procedure should be same for husband and wife. This law should not be pass. I saw woman who doesn`t think about husband`s health and think about her husband`s property. It will be property game for every women. Property is most important role in life.

hi this is rubbish law. Womens will do marry again and again this will be property game for her. Govt. ko aur koi law nahi dikhayi deta. India is corrupted country. He must think about this case not divorce case. Divorce case should be strict. Every woman want to take property then she will break marriage every year. It will be increase divorce cases in india. How can they decrease divroce cases. Divorcee woman have no right in property of husband because she is living separately.Today woman is taking high education and doing job. Govt, ko husband wife dono ke liye same law karna chahiye.

hi. those of who are pro this law saying genders should have equal rights then please understand that even the womans assets have to be taken into consideration. the property/assets shud be aquired after/during marriage and there also has to be a time frame for a woman to be with a husband to lay claim on property, how do you know its not a con/scam and the woman will divorce in 10 days. also western countries allow pre nuptial agreements, they should be allowed here. the problem is this country is run by dhitrashtras...

Suppose i have purchase a flat of 30 laks by working hard in last 10 years and i am paying an EMI of 18000 rs per month for same. I got married and that girl stayed at home for 10 days. then she left and take divorce and then as per this law he have equal share on my own property that means she is also 50 % owner of my property. If it is then why she will not bear the 50% EMI? Why she will not share my initial investment while i have done during purchasing of same? I think its a cruelty against men in India. I request Union Ministry of Law to pls re-look seriously on this, cause it will not decrease the DIVORCE, it will increase the DIVORCE, cause 498a is a weapon in the hand of girl.

It is sad really to read such biased and ill-informed comments that inadvertently reflect a sickening attitude towards equality and human rights. Firstly, in most cases, divorce is usually the last resort of most women who have suffered any kind abuse (mental, physial, emotional) and only want to live a life of dignity and its high time that the Indian law provided some respite to such women. Secondly, this law also works as some kind of safeguard for preserving a marriage since now an abusive husband cannot simply walk out leaving her destitute. He will now have to work equally to save his marriage and property. Ill-informed commentators should realise that compared to India, equal rights are favoured by most developed nations. This is evident in a high HDI (Human Development Index) which indirecly points to the level of empowerment of both sexes in a nation. A country is progressive beause there is more equality in a society where women have near equal access as men to nutrition, education, healthcare and every opportunity to develop herself and her children Thirdly, a woman is not just a wife and a girlfriend. In cases where she is a daughter or a sister, I`m sure these very people opposing this law so vehemently, would sigh in relief should such a situation arise because lie is unpredictable and the more humanistic the law, the better balanced and progressive the society.

it is pathetic that people with no exposure are beating such drums of human right so loudly. 90% cases of divorce and 498A are fake and filed with malified intention. These girls never ever had any claim against their father or brother. They never bother to go to court to seek redressal against their own family. When someone asks them to bring their share of property from their parents, they are called greedy and insensitive. When same set of girls demand these things from their spouse , it becomes their right. These people are seeking equality at the same time claiming helplessness in carrying their own burden.......the biggest hypocrisy of civilised indian society.

The moment you are divorced you have nothing to do with your spouse and so there should not be any compensation to a women. This will lead to the misuse of the divine bond of marriages as girls will get married and later can divorce their husband to get half of the share from their property.Even IPC 498A should be abolished stopping women to misuse it. Such laws will surely make men more insecure and people will hardly get married. I AM STRONGLY AGAINST THESE LAWS

The only options available for Indian men is to either turn gays or wear saree and bangles and sit at home and never get married.I am from India and happily married with a Australian girl only because of such Indian laws whereas in other parts of world men and women have equal rights.Indians boost their culture and claim a country with less number of divorce but the reality is one who wants divorce is charged with 498a and many other laws and men have to live as slaves of wife forever even if they don`t want to be in a relationship.In sumarry we are following Sati practice once married men and women can never get separate till they die.
