'Free Pak prisoners who've completed sentence'

New Delhi: In a significant judgement, the Supreme Court on Tuesday directed the government to immediately release 54 Pakistani nationals who are languishing in Indian jails despite completing their sentences and their national status having been established.

An apex court bench of Justices RM Lodha and HL Gokhale said the deportation in respect of these prisoners should be completed within one month from Tuesday.

The court said its order holds good for five similarly placed prisoners belonging to Bangladesh, Afghanistan and Iran.

Slamming the government for its failure to show concern and urgency to the prisoners' right to personal liberty, the court said, "We should honour the UN charter on human rights and the commitment we gave to ourselves to uphold liberty under Article 21 of the Constitution."

A list of 365 Pakistani prisoners was given by the Indian government to the apex court on November 28, 2011, a number of whom completed their sentences long ago.

Apex Supreme Court of India (Mr. Justice R.M.Lodha & Mr. Justice H.L.Gokhale) is requested kindly to look into the case of Sikandar-e-Azam Sani s/o Muhammad Khalid Butt presently confined/detained in the central jail, Kot Bhalwal, Jammu despite the fact that he has completed his 6-months additionaal rigorous imprisonment on 20th January, 2012. Rs. 3000/-was deposited on 30th December, 2011 with the Superintendent, C.J. Kot Bhalwal, Jammu as court fine. His national status, being a Pakistani national has already been verified/confirmed by the Minister of Interior, Government of Pakistan since long and communicated to the Pakistani High Commission in New Delhi accordingly. Apex Sumpreme Court of India is requested kindly to ensure his release/repatriation in view of directions dated 24th January, 2012 issued to the government of India.

Honorable Judges Mr. Justice R.M.Lodha & Mr. Justice H.L.Gokhale of the apex Supreme Court of India are respectfully requested to take notice of the detention of Mr. Sikandar-e-Azam Sani s/o Muhammad Khalid Butt who has even completed his 6-month additional R.I. on 20th January, 2012. His court fine was also deposited with the superintendent C.J.Kot Bhalwal, Jammu on 30th December, 2011 by the Legal Aid Committee. His nationality status has also been verified by the government of Pakistan since long and forwarded to the Pakistani High Commission in New Delhi accordingly.
