Delhi HC summons MCD, DDA heads for non-implementation of order

New Delhi: Taking exception to civic
agencies` failure to comply with its order for removal of
illegal encroachment, the Delhi High Court today summoned the
MCD Commissioner and DDA Vice-Chairman for May 12.

A Division Bench of Acting Chief Justice Madan B Lokur
and Justice Mukta Gupta directed the heads of DDA and MCD to
personally appear and explain the delay for non-implementation
of the order which was passed by the court on February 11 last
year.

"A year and two months have passed and the agencies have
failed to implement the order for removal of illegal
encroachment in two months. Each agency is passing the buck on
other," said the Bench.

"You cannot take the court for granted. Nobody bothered
to see the order..." also said the Bench.

In February last year, the Bench had directed the MCD
and the DDA to remove the illegal encroachments from the roads
meant for the residents of three group housing co-operative
societies on Rohtak road in Paschim Vihar area.

The court order had come after a petition filed by three
CGH societies housing more than 200 flats alleging that the
connected road has been encroached as a result of which the
passage of the residents was being blocked.

Despite various representation to the civic agencies, no
step has been taken so far and finally the residents had to
approach the high court.
