Lokayukta issues notice to leader of House of MCD

A show cause notice has been issued to Subhash Arya asking why an inquiry should not be initiated against him for interfering with demolition drive.

New Delhi: Finding prima facie evidence
against BJP politician and leader of MCD house, Subhash Arya,
the Lokayukta on Monday issued a show cause notice to him asking why
an inquiry should not be initiated against him for interfering
with the demolition drive of the civic agency.

"There is prima facie case for inquiry into the
conduct of Subhash Arya and the allegation of abuse and misuse
of his position in order to obtain gain or favour to himself
or other and cause undue harm to an Assistant Engineer (of
MCD) and failing to act in accordance with norms of integrity
and conduct which ought to be followed by a public functionary
of his class," Lokayukta Justice Manmohan Sarin said.

The order, issuing the show cause notice to Arya, has
come on a pseudonymous letter to the panel accusing the MCD
councilor that he attempted to interfere with the demolition
of an illegal structure at the fourth floor of a building at
Karol Bagh here.

The Assistant Engineer (AE), who filed an affidavit,
said the MCD did not follow the instruction of BJP leader
asking it not to demolish the illegal construction.

The leader also allegedly got the AE transferred.

"There is clear and cogent allegation of Arya having
intervened and asked the AE not to proceed with the
demolition and to give Sunny Ghai an opportunity to do the
demolition himself,".

"In cases of unauthorized construction carried out
under the patronage of politicians, it is difficult to find
direct evidence of the interest of such politicians or the
immediate relations in the property," the order said.
